Welcome to OpenCourt (“OpenCourt,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of all OpenCourt services, including our websites, mobile applications, and other online products and services that link to these Terms (collectively, the “Services”). By registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility
Users must be at least 13 years old. By accessing the Services, you confirm meeting this requirement and possessing legal capacity to enter the agreement. If using Services on behalf of an organization, you represent having authority to bind that entity.
2. Account Registration and Security
Account Creation: Certain features require account creation with accurate, complete information.
Security: You are responsible for protecting account credentials and all activities under your account. Report unauthorized use immediately to support@getopencourt.com.
Accuracy: Keep information current and accurate at all times.
3. Fees and Payment
Subscription & Transaction Fees: Some Services require payment. Fees, billing periods, and renewal terms are disclosed before charges occur.
Payment Methods: OpenCourt accepts payment through third-party processors like Stripe, authorizing charges to your chosen payment method.
Refunds: Except as required by law, all fees are non-refundable. Individual clubs set their own cancellation and refund policies for bookings.
4. Booking Policies
Reservations: Booking creates a contract between you and the relevant club—not with OpenCourt, which operates as a software platform.
Cancellations: Each club establishes its own cancellation windows and penalties.
No-Show Fees: Clubs may charge no-show fees disclosed during checkout.
5. Code of Conduct
You agree not to:
- Violate applicable laws or regulations
- Harass, threaten, victimize, or defraud users, clubs, or staff
- Post unlawful, defamatory, obscene, or infringing content
- Send unsolicited advertising, spam, or lottery solicitations
- Introduce malware or attempt unauthorized access
- Impersonate others or misrepresent affiliations
- Use automated bots without prior written consent
- Interfere with Services or other users' enjoyment
OpenCourt reserves the right to remove content or suspend accounts violating these Terms.
6. Support-Team Account Impersonation
OpenCourt support representatives may temporarily access or impersonate customer accounts to resolve issues with your implied consent.
Scope: Access is strictly limited to resolving the reported ticket.
Limitations: OpenCourt will not modify unrelated account information.
Transparency: Actions are logged, and the account holder receives notification upon request.
Opt-Out: Contact support@getopencourt.com to opt out.
7. User Content
Ownership: You retain all rights to submitted content.
License to OpenCourt: You grant OpenCourt a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely to operate and improve Services.
Responsibility: You represent having all necessary rights to grant this license and that content does not violate third-party rights or laws.
8. Intellectual Property & DMCA Takedown
All OpenCourt software, text, graphics, and materials are protected by copyright, trademark, and applicable laws. Subject to Terms compliance, OpenCourt grants you a limited, non-exclusive, non-transferable license for personal, non-commercial use.
DMCA Notice:
If you believe content infringes your copyright under 17 U.S.C. §512, submit notice including:
- Description of the copyrighted work allegedly infringed
- Location of infringing material (URL or screenshot)
- Your contact information (name, address, phone, email)
- Statement of good-faith belief that use is unauthorized
- Statement under penalty of perjury that information is accurate and you are the owner or authorized agent
- Your physical or electronic signature

Upon receiving valid notice, OpenCourt removes or disables access to material and notifies the posting user. Repeat infringers may face termination.
9. Third-Party Services and Links
The Services may integrate with or link to third-party services. OpenCourt is not responsible for such services, which are governed by their own terms and privacy policies.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. OpenCourt does not warrant uninterrupted, secure, or error-free operation.
11. Limitation of Liability
OpenCourt and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues arising from Services or these Terms. Total liability will not exceed the greater of $100 or amounts paid for the Service in the preceding twelve months.
12. Indemnification
You agree to indemnify, defend, and hold harmless OpenCourt against claims, liabilities, damages, losses, and expenses arising from your use of Services, violation of these Terms, or violation of third-party rights.
13. Force Majeure & Assignment
OpenCourt is not liable for delays or failures from causes beyond reasonable control, including acts of God, labor disputes, riots, war, terrorism, governmental action, and internet failures. You may not assign rights without prior written consent. OpenCourt may freely assign these Terms without notice.
14. Notices
OpenCourt may provide notices via email to your primary address, in-app/website banners, or by posting updated Terms. Notices are deemed given on the date sent. You are responsible for keeping contact information current. Legal notices to OpenCourt must be emailed to support@getopencourt.com and sent via certified mail to: OpenCourt, 1606 Headway Cir STE 9303, Austin, TX 78754.
15. Termination
OpenCourt may suspend or terminate your access at any time, with or without notice, for conduct violating these Terms or harming OpenCourt or other users.
16. Governing Law and Dispute Resolution
These Terms are governed by Texas law without regard to conflict-of-laws principles. Disputes are resolved through binding arbitration administered by the American Arbitration Association in Austin, Texas. Class actions are prohibited; claims proceed on an individual basis only.
17. Changes to These Terms
OpenCourt may update these Terms, revising the “Last Updated” date accordingly. Continued use after the effective date constitutes acceptance.
